These Terms and Conditions (“Terms”) govern your use of https://strikeandburn.com (the “Site”) and your purchase of products from Strike and Burn Brand LLC (“Company,” “we,” “us,” or “our”). By accessing the Site or placing an order, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to purchase products from this Site. By placing an order, you represent that you meet this requirement.

2. Orders and Acceptance

All orders are subject to acceptance and availability. We reserve the right to refuse, cancel, or limit quantities of any order at our sole discretion, including orders that appear fraudulent or unauthorized. After placing an order, you will receive an email confirmation. This confirmation does not constitute acceptance; we reserve the right to cancel orders prior to shipment.

3. Pricing and Payment

All prices are listed in USD. Prices are subject to change without notice. Payment is required at the time of purchase. We accept major credit cards and other payment methods displayed at checkout. Applicable sales tax and shipping charges will be calculated at checkout.

4. Shipping and Delivery

Orders are typically processed within 2 to 3 business days. Shipping times are estimates and not guaranteed. Once an order is transferred to the carrier (e.g., USPS, UPS, FedEx), risk of loss transfers to the customer. We currently ship within the United States only.

5. Returns and Refunds

Refunds, returns, and exchanges are handled in accordance with our Refunds & Returns Policy. By making a purchase, you agree to comply with these rules. Key points include:

• Final sale items, gift cards, and custom or made-to-order products are not returnable unless defective or damaged.
• Damaged or incorrect items must be reported within five (5) business days of delivery.
• Approved refunds are issued to the original payment method.
• Return shipping and carrier responsibility follow the policy outlined on the Refunds page.

6. Product Use and Candle Safety

Our candles must be used responsibly. Always follow proper safety precautions:

• Trim wick to 1/4 inch (6 mm) before lighting.
• Keep wick centered and free of debris.
• Burn on a heat-resistant, level surface away from drafts.
• Never leave a burning candle unattended.
• Keep away from children and pets.
• Do not burn below 1/2 inch of wax remaining.

We are not liable for damage or injury resulting from misuse, improper handling, or failure to follow safety instructions.

7. Trademarks and Intellectual Property

“Strike + Burn®” and the Strike + Burn® logo are registered trademarks of Strike and Burn Brand LLC, registered with the United States Patent and Trademark Office. All other content on this Site, including text, graphics, images, product names, and designs, is the property of Strike and Burn Brand LLC and is protected by applicable intellectual property laws. Unauthorized use, reproduction, or distribution of these trademarks or any other Site content is prohibited.

8. Disclaimer of Warranties

All products and services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

9. Limitation of Liability

To the fullest extent permitted by law, Strike and Burn Brand LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the Site or purchase of products. Our total liability shall not exceed the amount paid for the product giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Strike and Burn Brand LLC, its affiliates, employees, and contractors from any claims, damages, or expenses arising from your violation of these Terms or misuse of our products.

11. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the purchase or use of any products shall be resolved through binding arbitration, rather than in court, except that either party may bring claims in small claims court if eligible. Arbitration shall be conducted on an individual basis in accordance with the rules of the American Arbitration Association (“AAA”). The arbitration will take place in Nevada, unless otherwise agreed by the parties. The arbitrator’s decision shall be final and binding.

Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis only and not as a class, collective, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions

Nothing in this section prevents either party from seeking injunctive or equitable relief in court for matters related to intellectual property rights, unauthorized use, or misuse of the Site.

12. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Continued use of the Site or purchase of products after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.

14. Affiliate Program

We run an affiliate program for people who want to earn a commission by sharing Strike + Burn. Joining is optional and needs our approval. The program is covered by our separate Affiliate Terms; if they conflict with these Terms on an affiliate matter, the Affiliate Terms apply. Orders placed through an affiliate’s link follow these Terms like any other order, and you pay the same price.

15. Gift Cards

Strike + Burn gift cards are digital and sent by email, in amounts of $25, $50, $75 or $100. They never expire and have no fees. A gift card can pay for products, shipping and tax on our Site, and any balance left stays on the card for a later order. Gift cards cannot be bought with Burn Bucks or coupon codes, and they are final sale. If a gift card order is refunded or cancelled, that gift card is turned off.

16. Burn Bucks Rewards

Burn Bucks is our free rewards program for customers with a Strike + Burn account. You earn 1 Burn Buck for every $1 spent on products, after discounts and not counting shipping, tax or gift cards. Every 100 Burn Bucks can be used for $5 off, starting at 100, for up to 50% of the products in an order; Burn Bucks cannot be used on shipping or to buy gift cards. They can be used together with coupon codes and they never expire. You can also earn bonus Burn Bucks: 50 for signing up, 50 on your first order, 100 on your birthday and 25 for a product review (verified buyers only). If an order is refunded or cancelled, the Burn Bucks earned on it are removed and any Burn Bucks used on it are returned. Burn Bucks have no cash value. We may change or end the program.
